Right of withdrawal
Methods and process
According to article 45 and seq. of Legislative Decree n. 21 of 2014, if the Customer is a consumer, he is entitled to withdraw from the purchase contract for any reason, without explanation and penalty. The customer can exercise the right of withdrawal within 30 working days, by filling out the withdrawal form available here
The completed form has to be sent by e-mail to: email@example.com, by ordinary post or certified mail to the following address: Boutique D'Urso di Luca D'Urso, Via San Nicola 54, 83042 - Atripalda (AV).
In case of withdrawal from the contract, all the payment made in favor of D'Urso boutique will be refunded to the Customer, including the delivery costs, without delay and within 14 days from the date the customer communicated back the decision to withdraw from the contract. To meet the deadline, the Customer should return the goods before the end of the cooling-off period of 30 days. D'Urso boutique may withhold the reimbursement until he has not received the goods back or until the customer has supplied evidence of having sent the goods back pursuant to article 56 of Legislative Decree n. 206 of September 6, 2005 - Consumer Code.
The above mentioned refund will be made by using the same way of payment used for the first transaction, except the customer otherwise expressly agreed; in any case he will not incur in any additional fees as a result of such reimbursement. If the Customer decides to be refunded by bank transfer, he must promptly provide his bank account details (IBAN and bank account holder’s name).
In the event that the Customer was not concerned with making the return of the goods at his own expense by instructing a courier to collect the returning goods, D'Urso boutique will do it. In this case, the direct cost of returning goods will be charged to the Customer.
The Customer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the same goods.
If the Customer decides to independently send the goods subject to withdrawal, he is liable of any responsibility for the consignment until receiving it in our warehouse. If the goods are damaged during transportation, D'Urso boutique will inform the Customer (within 5 working days of receipt of goods in its own stores), in order to enable him to have a timely complaint against the carrier chosen and to obtain reimbursement of the value of the good’s value (if insured); in this case the product will be available to the Customer for its return, while canceling the request for withdrawal.
D'Urso boutique is not liable in any way for the damage or theft/loss of goods returned by uninsured shipments.
In case of self-delivery of goods by the Customer, the refund will be suspended until the date of receipt of the same at the warehouses D'Urso boutique or, as an alternative, until the moment the Customer will attest the delivery using receipt.
The right of withdrawal is valid by acknowledging the essential integrity of property (packaging and/or its contents):
- The disposable card is perfectly intact and, therefore, it was not been removed from the item.
- All labels, fabric or pendants, are perfectly intact and, therefore, they were not been removed from the item.
- Any returning item is in the same condition which it was sent to Customer and it must be orderly packed.
- Any returning item wasn’t worn and/or washed and/or ironed and/or treated in no way.
In case of forfeiture of the right of withdrawal, the goods remain in the warehouses D'Urso boutique, available to the customer for collection at his own expense.
IT IS NOT ALSO PERMITTED THE RIGHT OF WITHDRAWAL FOR THOSE PRODUCTS DAMAGED IN TRANSIT AND FOR WHICH IT WAS NOT INCLUDED THE SPECIAL RESERVE OF CONTROL ON THE COURIER DOCKET.
WARNING! The products covered by the withdrawal must be perfectly intact and present in original condition, returned in its packaging or in any case in order to preserve its integrity, under penalty of forfeiture of withdrawal and the re-sending of the products to the Customer.
THE RETURN PROCEDURE MUST BE AUTHORISED BY D'Urso boutique AND NO RETURN ACTION OF PRODUCTS WILL BE TAKEN ON THE INITIATIVE OF THE CUSTOMER.

Guarantee of conformity
D'Urso boutique offers direct guarantee against any lack of conformity and ensure the replacement of the product “non-compliant”. “Non-compliant” means a product different from that stated at the order and/or a product technically not compatible with the information given by the customer when ordering. After reporting from the customer of the non-conformity detected, D'Urso boutique will replace the product or refund as indicated in the order confirmation.
Also there are not covered here the products damaged during transport for which was not included the specific reserve control on the courier docket. If the product is found not compliant, the Customer will receive within 15 working days the new products corresponding to his initial order. If the stock of the products initially ordered were sold out, the Customer may request a refund or choose another available product. In this case the price difference will be charged or refunded to the Customer. The return of products will not be accepted and they will not be replaced if they do not correspond to their original condition.
D'Urso boutique informs that the list above may, at any time, be subject to change even following inclusion of new categories of Products/Services present on its website. These new restrictions will be effective against the Customer only upon posting on the site.
The conditions regarding the exercise of withdrawal rights, which form an integral part of the General Conditions of Sale, are governed by Italian law and in particular by Legislative Decree No 206 of September 6, 2005 of Consumer Code at Ist paragraph “The consumers' rights in contracts”.
